Disclaimer

A binding document applicable to every user of the EmptyFast site and to every client submitting a request via our forms or messaging channels.

1. Status as a pure intermediary

EmptyFast is a brand operated by Redwood Aviation. EmptyFast is not an air carrier, holds no Air Operator's Certificate (AOC), and does not operate, own, charter or control any aircraft. Its role is strictly limited to connecting a client with a duly certified third-party airline or operator.

The contract of carriage is entered into directly and exclusively between the client and the operator. EmptyFast is never a party to that contract, even where it has facilitated its conclusion.

2. No operational liability

EmptyFast and Redwood Aviation expressly disclaim any liability, this list being non-exhaustive, relating to: delay, cancellation, diversion, interruption or non-performance of a flight; change of aircraft, registration, crew, schedule or airport; any fault, breakdown, damage, non-conformity or maintenance status of the aircraft; any incident, accident, personal, material or immaterial damage occurring before, during or after the flight; loss, theft or damage to baggage and personal effects; denied boarding for documentary, customs, health or security reasons.

3. No financial liability

No indemnity, compensation, discount, refund or damages may be claimed from EmptyFast or Redwood Aviation on any grounds whatsoever. This notably excludes indirect losses, loss of opportunity, loss of profit, reputational damage, accommodation costs, substitute transport, rerouting or any ancillary expense incurred by the client or their travelling companions.

Any financial claim must be addressed directly to the operator of the flight, the sole party liable for any compensation obligations under the contract of carriage and applicable regulations.

4. Indicative nature of the information published

The prices, aircraft, photographs, flight times, availability, registrations and descriptions published on the site are provided on a purely indicative and illustrative basis. They are generated from market references and repositioning scenarios, constitute neither a firm offer nor a contractual commitment, and may differ from operational reality at the time of booking.

The photographs shown illustrate aircraft categories and do not necessarily represent the airframe actually chartered. Only the charter contract issued by the operator, accepted and paid for, is binding on the parties.

5. Safety and selection of operators

Although we favour certified operators, EmptyFast carries out no technical audit, provides no safety guarantee and assumes no obligation of result as to the quality, regulatory compliance or solvency of third-party operators. It is for the client to verify, if they wish, the certifications and insurance of the operator before making any commitment.

6. Force majeure and external events

No liability may be sought in the event of any occurrence beyond the reasonable control of the parties: weather conditions, slot restrictions, airspace closure, decision by a civil or military authority, strike, conflict, cyberattack, infrastructure failure, epidemic or any administrative measure.

7. Links, third-party content and service availability

The site may link to third-party services (messaging, forms, mapping) over which EmptyFast has no control as to content or availability. The site is provided "as is", with no guarantee of continuity, absence of error, or permanent accuracy of content.

8. Acceptance and enforceability

Browsing the site, sending a request via the form, or any contact made via messaging constitutes full, unreserved acceptance of this disclaimer, the terms and conditions, and the data protection policy.

Should any clause be held void or unenforceable, the remaining clauses shall retain full effect and the affected clause shall be deemed replaced by a stipulation of equivalent scope consistent with applicable law.

9. Governing law and jurisdiction

This document is governed by the law applicable at the registered office of Redwood Aviation. Any dispute relating to its validity, interpretation or performance falls under the exclusive jurisdiction of the courts of that jurisdiction, following an attempt at amicable settlement lasting at least thirty days.
